Your use of the Crescentquail web site ("crescentquail.co.uk") and purchase of the products or services ("Products") on it means that you agree to these terms and conditions ("Terms").

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

1. Use of Website

1.1 If you are under 18 or under the legal age to enter into enforceable contracts in the jurisdiction from which you are accessing this Website, you may use the Website only with consent of a parent or guardian.

2. Your Account

2.1 You may create an account for your personal use (" User Account "). Creating a User Account entitles you receive some great benefits, including to receive notice of special offers, to maintain an address book for recipients of Crescentquail Online Supply, to set reminders for birthdays or special occasions, or to view your order history.

5.1 The content of this Site is owned by or licensed to crescentquail.co.uk (Crescentquail). You may view or print individual pages only for your own personal use.

5.2 Crescentquail may suspend, alter, restrict or terminate at any time access to or use of this Site.

6. Limitation of liability

6.1 This Site should only be used for information purposes. Crescentquail shall not be liable for any damage or loss that may occur in the use of any of the information contained or advice given in this site except as stated in the terms and conditions of sale (where applicable)and to the extent that such liability cannot be excluded by law. Crescentquail is not responsible for the Site's accuracy or its fitness for a particular purpose or the reliability of the access to this Site.

6.2 Crescentquail is not liable for any damages or losses resulting from your use of or inability to use this Site. Crescentquail does not guarantee that this Site will operate free of error or that it is free from computer viruses or any other contaminating computer program.

We will not be liable to you or in breach of the Contract for delay or failure to perform due to any causes beyond the reasonable control of Crescentquail or its suppliers, including, but not limited to, acts of god, civil commotion, industrial dispute, riots, flood, and legislation.

7.1 This Site also contains links to other sites which are not under the control of and are not maintained by Crescentquail These links are provided for your convenience only and Crescentquail is not responsible for the content or availability of those sites.

8. Data protection and privacy

8.1 Any details which you provide to us from which we can identify you are held and processed in accordance with our Privacy Policy.

9. Payment Options

9.1 We accept all Card Payments via CARDSAVE/WORLDPAY security enabled systems. We DONOT accept American Express "AMEX" but all major credit card are wellcome.

9.2 You can either order online, or over the phone using your credit card.

10. Pricing and Purchase

10.1 All prices quoted are in British pounds (£) and include Value Added Tax (VAT).

10.2 The buyer shall be liable to pay such value added and other tax as is applicable to the goods supplied and as dictated by legislation relating to the UK, European Union or foreign trade.

10.3 UK buyers as well as overseas buyers from within the European Union are required to pay VAT at the standard UK rate.

10.4 The price of the goods shall be the price quoted on the seller’s published website current at the date of acceptance of the order unless otherwise agreed verbally in writing between the buyer and the seller.

10.5 If payment is made by cheque or bank transfer, goods will not be dispatched until the required funds are fully cleared.

10.6 The processing of a payment and acknowledgement of an order does not constitute a legally binding contract. The Seller retains the right to cancel any order until the point of delivery.

10.7 Prices and descriptions are subject to change at any time.

11. Delivery & Acceptance of the Products

11.1 The seller reserves the right to use whichever courier is deemed the most appropriate to each individual contract.

11.2 The delivery times stated on the seller’s website should be treated as estimates and are not guaranteed. The seller is not liable for any delays caused by couriers or other third parties.

11.3 The seller has a legal duty to complete the contract within 30 days beginning from the day after the date of order. If the contract exceeds 30 days, without prior consent from the buyer, the contract must be treated as though it had never been made.

11.4 If, upon placing the order, the required delivery location is not available, the buyer should contact the seller immediately to organise an alternate delivery method.

11.5 For palletised deliveries, if there is no one to collect the goods at the delivery point, they will not be delivered and will be redelivered on the next working day. You will be charged a redelivery fee (£50 + VAT per pallet) for this purpose.

11.6 You are responsible for checking the Products and endorsing any relevant documentation at the point of delivery to confirm inspection and acceptance (whether that is when the Products are made available to you or your appointed carrier for your collection, or on delivery to your nominated premises if delivery is made by the Carrier) and must raise any issues immediately with us, and in any event no later than 24 hour after such delivery (After which you shall be deemed to have accepted the Products).

11.7 After acceptance You shall not be entitled to reject Products which are not in accordance with the contract and We shall have no liability whatever to You in respect of those Products.

11.8 Your goods are covered with our goods in transit insurance policy.

11.9 Refused Deliveries :
If you do not cancel your order in writing but reject the delivery without stating any reason, the return shipping fee will be charged to you since the order has been sent to you, and the conditions in 13.1.3 will apply.

12. Ordering and Stock Availability

12.1 We aim to display only items that are in stock and which can be dispatched to you quickly. From time to time we may sell out of some lines, in which case we will aim to advise you within the 10-14 day delivery period. If this does occur, you will be given the opportunity to order an alternative or receive a full refund for the full price you paid.

12.2 Crescentquail makes no representation as to the goods, items, products or services referred to in, or sold from, this Site as being available or suitable for use.

12.3 Products sold on crescentquail.co.uk are for use in a domestic setting. If you wish to purchase items for commercial use please contact Crescentquail Customer Services on 07477 550230 to discuss your product needs. Products for use in commercial settings get more wear and tear than in a domestic setting and are necessarily more robust. For this reason we request that you contact us to discuss your requirements.

13. Cancellation, Returns & Refunds

13.1 Cancellation

13.1.1 For special quantity orders, if you wish to cancel your order within 7 days following the day your order was placed, 25% of the invoice price will be charged, if you wish to cancel on any day after the 7th day, 28% of the invoice price will be charged as a restocking fee and a two-way courier fee even if the product has not been delivered (due to the plans made).

13.1.2 For purchases made from stock within the first 24 hours, if the product is not taken out of stock and not delivered to the carrier courier company, the entire payment will be refunded to you following the cancellation process you will make.

13.1.3 At the end of 24 hours, if the product has been taken out of stock and delivered to the courier company but the product has not yet been delivered to you, in this case 3% of the invoice amount and two-way shipping fee, if the product has been delivered to you and the return process has been initiated after this period, 18% of the invoice amount will be deducted from your account as a restocking fee and the remaining amount will be refunded to you. Shipping costs paid by you during the return process are not refundable

13.2Unless faulty, goods purchased may only be returned provided:

13.2.1 Proof of purchase is presented.

13.2.2 The product must be unused, in its original packaging, undamaged and in a resalable condition.

13.3 With the intent to obstruct the movement of viruses that cause deadly diseases such as Bird Flu we are unable to accept returns on certain types of goods, these being:

13.3.1 On special request, for the purpose of specially prepared all incubator metarials,

13.3.2 On special request manufactured cages or on demand all cages which are requested to be produced,

13.3.3 All consumables and equipment used for the purpose of poultry and Gamebirds.

13.4 If you change your mind about goods purchased online you must notify us within 21 calendar days from the day after you receive the order from us of your wish to cancel all or part of your order. This must be done by emailing us at sales@crescentquail.co.uk or please contact us using our telephone us on 07477 550230.

13.5 Once you've cancelled an order you then have a further 21 days for the goods to reach us. Enclosed with your order is a Returns Form, please complete this and return using the address provided. It is important that the returned goods are received by us in a resalable condition so please ensure the goods are appropriately packaged and it is advised that a tracked delivery service be used to avoid any complications in processing your return (the cost of the postage to return the goods is to be paid in full by the customer and will not be refunded).

13.6 If product has been used and is not in the same condition as was sold (original, manufacturer packaging with all accessories) then there will be no refund.

13.7 If we have agreed to collect the products from you, we will charge you the cost to us of collection.

13.8 Provided these conditions are met a refund will be made within 21 days of receipt of the goods.

13.9 Cancelled refunds will be made within 30 working days in reciept of your email requesting cancellation of order.

14. Warranties

14.1 We aim to deliver goods of the highest quality. All electrical products listed on the seller’s website are subject to a minimum 12 month warranty.

14.2 All our incubators have a 1 year warranty from date of purchase, if you wish to take advantage of a special 2 year warranty, please contact customer services on 020 8591 2900 or register online within 30 days of purchase.

14.3 If you wish to extend your 2 year warranty for an extra year, you must contact us to extend your warrenty no later than 30 days prior to date of expiry and must be paid in full.

14.4 This extended guarentee is for incubator machines and is only valid for the working parts in morder to ensure that the guarantee is valid it is necessary to use the incubator for it’s purpose and must be kept clean & dry at all times.

14.5 The warranty covers all product faults with the exception of those attributed to intentional or accidental damage and/or reasonable wear and tear.

If a fault should develop within the given warranty period, the buyer should inform the seller immediately.

14.6 if your product need servicing or a defect has arisien uder the warrenty period the customer is liable for the shipping/return costs.

14.7 For products that cannot be shipped, on-site service may be requested, in which case crescentquail should be contacted.

15. Changes to the terms

15.1 Crescentquail reserves the right ot remove, modify or change, without notice, any information on this Site from time to time. Crescentquail may change these terms at any time by posting notice of the changes on the Site. If you use the Site after Crescentquail has posted the changes you will be bound by the new terms. You should therefore ensure that you read the terms each time you use the Site.

16. General

16.1 E-mails to you will be sent to the address you specify to us. You must only provide us with a valid e-mail address and it is your responsibility to inform us of any changes to that address.

To the extent that any provision of these terms is found by any court or authority to be invalid, unlawful or unenforceable, that provision will be deemed not to be a part of these terms and will not affect the enforceability of the remainder of these terms, nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.

The headings in these terms are for convenience only and do not affect their interpretation.

These terms supercede any representation made by us or any of our employees or agents.

17. Statutory rights

17.1 The consumer's contract with crescentquail does not effect the consumer's statutory rights.

18. Governing law and jurisdiction

18.1 These terms and your use of this Site are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.

19. Products

19.1 Please note that a number of the products on crescentquail.co.uk are flatpacked, so some assembly will be required.
